Dr Mitchell Roslin has filed a lawsuit against Spirit Airlines after he was kicked off a delayed flight at LaGuardia Airport allegedly for asking for water for his pregnant wife. The aircraft had been standing on the tarmac for two hours when Roslin requested the water. The airline attests he was escorted off the aircraft for making a scene, talking about terrorism and reducing another passenger to tears during the delay. A charge Roslin denies.
The lawsuit was filed in September in state the Supreme Court in White Plains although Spirit Airlines has now filed papers in federal court asking that the lawsuit be heard there because the two parties are from different states.
The airline has already refunded the cost of their tickets for the flight but Roslin is asking for $11 million in damages from Spirit Airlines.
